CONTRACT FOR WEDDING PHOTOGRAPHY/VIDEOGRAPHY

The contract is between Nasha Gee Photography (the photographer) and the client as detailed below:

1. A SUMMARY OF THE CONTRACT

The photographer is responsible for providing for the client a photographic service and products as detailed in the invoice sent to the client. The client undertakes to engage the photographer for this coverage for the price as detailed in the invoice.

2. THE COVERAGE

Coverage will be provided by Nasha Gee Photography using the details provided on the booking form. Nasha Gee Photography cannot be held responsible for the lack of coverage caused by the bride, bridegroom or other members of the wedding party not being ready on time, nor by restrictions placed on Nasha Gee Photography by officials of the church, register office, venue staff members, other vendors or licensed marriage venues. Nasha Gee Photography does not guarantee any specific picture nor to include any specific background, location, props, or arrangement, although every effort will be made to interpret the client’s wishes. Nasha Gee Photography is limited by the guidelines of the ceremony official or reception site management. The client agrees to accept the technical results of their imposition on \nasha Gee Photography. Negotiation with the officials for moderation of guidelines is the client’s responsibility. Nasha Gee Photography will offer technical recommendations only.

3. PAYMENT ARRANGEMENTS

The client will pay the photographer a total fee of £ (price of package) subject to the following terms:

  • A non-refundable £200 booking fee to secure the date and payable on execution of this agreement. This booking fee is non-refundable. The booking will not be transferable in the event of cancellation 8 weeks before the date of the wedding, it being the agreed loss suffered by the photographer due to cancellation.

  • 50% of the payment 6 months before the wedding date or before we do anything listed on the package and then the rest of the payment will be due 4 weeks before the wedding.

  • Cancellation less than 120 days before the date of the wedding will require 20-40% payment (calculated based on crew size at £120per photographer) and cancellation less than 90 days before the date of the wedding will require payment in full. All cancellations must be via email and the client must confirm the photographer has seen the request. The cancellation conditions above will apply for postponed weddings if the photographer is not able to reschedule for the new date and time. The fee for postponed weddings is subject to change upon Nasha Gee Photography's discretion.

  • Any additional payments for albums, images on usb and other services are to be made when that order is placed. Prices for orders placed over one year after the date of the wedding may be subject to change. This includes orders that are part of the initial wedding package e.g. the bride and groom’s album, usb etc.

4. COPYRIGHT

The entire copyright in the photographs is retained by Nasha Gee Photography at all times throughout the world. Where a disc of photographs has been provided to the bride and groom as part of their wedding collection, these photographs may be printed, and displayed online, for personal but not commercial use. The photographer retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting their work.

The photographer grants the bride and groom a non-exclusive, non-transferable, perpetual, personal-use license (limited licence) to reproduce Media via print only for any non-commercial use, including but not limited to reprints, enlargements, gifts to family and friends, slide shows, and web pages.

5. IMAGE SIZE, COLOUR, STYLE AND COMPOSITION ALL IMAGE SIZES ARE NOMINAL.

The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes not possible to record or print the exact colour as seen by the human eye. There is no right to reject on the basis of style or composition. All images will be adjusted for exposure, brightness, contrast, sharpness, etc according to the photographer’s judgement. Retouching, digital manipulation and artist finishing are not included.

6. ATTENDANCE

In the unlikely event that the appointed photographer is unable to complete the coverage due to unforeseen circumstances, Nasha Gee Photography reserves the right to appoint another photographer to attend on their behalf to undertake the photography. The location of the wedding portrait shoot has to be within 10 miles of the reception venue. Otherwise, a charge may apply (fuel cost).

7. INDEMNITY

The photographer shall only be responsible for obtaining in any clearances for third party copyright works, trade marks, designs or other intellectual property if this has been expressly agreed before the day of the wedding. In all other cases the client shall be responsible for obtaining such clearances and will indemnify the photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.

8. LIMITATION OF LIABILITY

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

9. WEATHER AND/OR DELAYS

Weather permitting, the photographs will be taken as agreed. In the event of inclement weather, the photographer, in cooperation with the client, will make the necessary changes to the schedule and will do their best to produce coverage of the wedding within the time allocated to them.

10. REQUESTED PHOTOGRAPHS

Nasha Gee Photography will honour requests for specific photographs subject to the following: weather and time permitting; availability and the cooperation of the person(s) concerned. All such requested photographs must form part of the client’s final wedding order. The photographer can refuse requests if they pose a risk to health or damage to equipment and if it stops the photographer from capturing other key moments of the day. Any directions issued to clients or by clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot. 

11. PRINTS / REORDERS

All prints and reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.

12. FORCE MAJEURE OR ACT OF GOD.

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

13. HARASSMENT

The Clients acknowledge that they are responsible for ensuring appropriate behaviour by their guests, wedding party, and other vendors. In the event that the Photographer identifies any inappropriate, threatening, hostile, or otherwise offensive behaviour directed at them, their assistants, or their equipment, Photographer reserves the right to end coverage of the events, retain all fees paid by the Client, and hold no further responsibilities to the Clients. Photographer agrees to notify the Clients of any of the above listed behaviours, and give them an opportunity to correct such behaviours, or remove the offending individuals from the venue prior to ending event coverage.

14. DELIVERY

We will endeavour to deliver digital files as quickly as possible on average within 4 weeks for images and within 20 weeks* for the videography, however this could take up to 20-26 weeks* during busy periods. All hard copies of the media will be sent via post (royal mail first class) with in UK Once the digital files have been approved. If the client wishes to get it sent out of the country they would need to provide payment for the costs prior to posting.

15. GOVERNING LAW

This agreement shall be governed in accordance with the laws of England and Wales.

16. COVID (LOCKDOWN) POLICY

In case you can no longer have the wedding on the original booking date we would be able to move the booking free of charge to another date within 2 years of the original booking. If you wish to move the booking to a date later than 2 years additional charges may incur due raising running costs and inflation. If you wish to fully cancel the booking we would send a refund minus £150 admin fee.
